    even if fuel is empty and battery is diconnected?

    If I were an importer or exporter and I incurred a loss as a result of neglect, misconduct etc. etc. of a subcontractor appointed by my forwarding/ clearing agent I would, under common law, be able to sue the agent and his subcontractor jointly and severally for the amount of the loss I incurred. However, most agents and their subcontractors have Standard Trading Conditions which protect them against exactly this type of claim so, as Manaadiar says, one would need to go into the individual case very carefully in order to arrive at a definitive answer.
